New publication on Monitoring State Compliance with the UN Convention on the Rights of the Child
This open access book is the first publication that discusses the core attributes of each article in the UNCRC, analysing every child’s right, as well as the latest jurisprudence of the UN Committee on the Rights of the Child. The chapter on Article 8, the right to preservation of identity, begins with testimonies of children, addressing the need to have access to free birth certificates and the need to make the process of obtaining documents simpler. The chapter also analyses the link between Article 8 and other Articles of the UNCRC and identifies two attributes to this Article:
- Establishment of Criminal and Procedural Preventive Measures – to criminalize enforced disappearances and irregular adoptions and provide victims with remedies such as re-establishing their identity, speedy family reunification and rehabilitation;
- Establishment of Protective Legal and Administrative Procedures – to introduce laws to protect children affected by crimes that infringe on their identity. These laws should be without time limitation in bringing such cases before a court of law.
CHIP welcomes this publication, as it provides an invaluable frame of reference for all actors in the field of children’s rights. In particular, CHIP supports the two attributes to Article 8 that provide the basis for the development of indicators against which to measure States Parties progress in the realisation of the child’s right to have their identity preserved and restored.
